Terms & Conditions

1. General provisions


1.1 The present terms and conditions (hereinafter Terms and Conditions) apply to the legal relationship arising between webshop onega.ee (hereinafter onega.ee) customers (hereinafter Buyer) and webshop onega.ee owner company ONEGA OÜ (hereinafter Seller) upon purchase of products from onega.ee webshop. The present Terms and Conditions establish the rights and liabilities of the Seller and the Buyer, their responsibilities, product acquisition, payment terms, delivery and reclamation procedures and general information about services provided by the Seller.

1.2 The Seller hereby reserves the rights to amend or supplement the present Terms and Conditions without prior notice. The changes will be published on onega.ee website and they become valid as of publication of the changes on onega.ee website. In case the order was submitted before the purchase terms and conditions became valid, the terms and conditions valid at the time of ordering will be applied unless provided otherwise by law or the present Terms and Conditions.

1.3 The Seller is in no way responsible for possible damages resulting from the Buyer not reading the present Terms and Conditions.

1.4 Additionally to the present Terms and Conditions, legal relationship between Parties arising from purchasing from onega.ee is governed by the legislation of the Republic of Estonia.

2. Customer information and data protection


2.1 Personal data presented by the Buyer to the Seller is handled according to the Data Protection Law. Data is forwarded to third persons only on the consent of the Buyer or in cases provided for by law.

2.2 The Buyer is responsible for not disclosing his/her login information (e-mail address and password) to third persons. The Seller is not responsible for any damages resulting from disclosure of login information of the Buyer to third persons on the fault of the Buyer.

2.3 The Buyer is responsible for accuracy of the information he/she presents. The Seller is not responsible for any damages resulting from inaccuracy of information presented by the Buyer.

2.4 If information presented by the Buyer upon registration changes, the Buyer shall immediately update the information on onega.ee website. The Seller is not responsible for any damages resulting from inaccurate or outdated information presented by the Buyer.

2.5 The Seller has the right to immediately and without prior notice to limit or suspend access of the customer to onega.ee website and deny service provision to the Buyer, if the Buyer acts or fails to act with the purpose to undermine, violate, disrupt or disturb the operations of onega.ee webshop.

3. Availability of products, product price and information


3.1 The currency in our online shop is EURO. All onega.ee webpage prices are VAT-inclusive.

3.2 onega.ee has the right to change price and product information; the changes are valid as of publication on onega.ee webpage.

3.3 Availability and price of products on onega.ee webpage may change. Changes are valid as of publication on onega.ee webpage.

3.4 We ship within 1-3 working days. In rare cases it might take up to 14 days to ship the goods.

4. Placing an order


4.1 Buyers can place on order via webpage ordering system and via e-mail info@onega.ee (contact onega.ee).

4.2 If delivery of the order should not be possible, the Seller has the right to offer a possibility to the Buyer to choose another equivalent product. In case the Buyer does not want the offered replacement product, the order will be cancelled and if the order has already been paid for, the Seller will reimburse the payment to the Buyer within 7 business days to the Buyer’s banking account from which the payment had been made.

5. Entering a contract


5.1 Contract of purchase and sale between the Buyer and the Seller is deemed valid when the Buyer has paid for the products to the banking account of the Seller or in cash to an authorised representative of the Seller.

6. Cancelling an order


6.1 The Buyer can cancel his/her erroneous order by informing the Seller via e-mail, telephone or other communication channels.

6.2 The order will be automatically cancelled if the Buyer has not paid for the products within three business days as of due date.

7. Payment for products


7.1 To pay for his/her purchase, the Buyer can use the following payment methods: bank transfer to the Seller’s banking account, PayPal, cash upon receiving the products, payment card at ONEGA OÜ office.

8. Delivery of the products


8.1 The Buyer can receive the products at the Seller’s office in Tallinn, Kadaka tee 52, warehouse 7, after the representative of the Seller has notified the Buyer that the purchased products have arrived at the office.

8.2 If requested, the products will be delivered to the Buyer with a courier. In such case, delivery fee will be added to the price of the products according to the pricelist available on onega.ee website.

8.3 The Seller is not responsible for possible delivery delay of the products and any resulting damages.

9. Refusing the purchase


9.1 According to the legislation of the Republic of Estonia, the consumer who is a natural person has the right to withdraw from purchase within 14 calendar days as of delivery of the products.

9.2 The returned products must be unused and in original packages. The products must bear all original stickers and labels. Product package can be visibly opened only in case if it would not have been possible to examine the products any other way.

9.3 The right to withdraw from the contract of purchase and sale is not valid in case of products that have been manufactured considering the personal characteristics or special needs of the Buyer.

9.4 If the Buyer wishes to terminate the contract of purchase and sale, he/she will immediately
(within 14 calendar days as of delivery of the products) inform the Seller of such wish via e-mail
info@onega.ee and adds photo of the products and package information. The Seller reserves the
right to request additional photos of products that are to be returned.

9.5 The Buyer shall bear any postal fees related to returning the products except if the products
delivered to the Buyer do not comply with the order.

9.6 Upon termination of the contract, the products must be returned immediately (within 30
calendar days).

9.7 In the event of returning the products, the Seller will offer the option to replace the products
with other products incl. price recalculation.

9.8 In case the Buyer does not want the offered replacement product, the Seller will reimburse
the payment to the Buyer within 7 business days to the Buyer’s banking account. Repayment
takes place only to the banking account from which the order was paid for.

9.9 The Buyer agrees that the Seller will deny further provision of services upon misuse of the
contract termination right by the Buyer.

9.10 The products cannot be returned if the Buyer is a legal person.

10. Guarantee


10.1 A guarantee of at least 24 months applies to all products purchased from onega.ee webshop.

10.2 Within the first six months as of delivery of the products, it is expected that the deficiency was present already at delivery of the product. Rebuttal of this assumption is the responsibility of the Seller. The Buyer is entitled to apply to the webshop by sending an e-mail to info@onega.ee no later than within two months as of detecting the deficiency. The Seller has the right to accept the product to expert examination.

11. Settlement of disputes


11.1 Disputes between the Seller and the Buyer are solved by negotiations. If a mutual agreement cannot be reached, the Parties are entitled to take the matter to the Consumer Protection Board or Harju County Court. Solving of disputes is governed by the legislation of the Republic of Estonia.

12. Coupon codes in our online store


If you have discount code and want to use it in our online store then you need to follow these steps:

1) Go to Cart and enter your coupon code into ‘COUPON CODE’ field. After that press ‘APPLY COUPON’ button.
2) Check your order price and if everything is correct then press ‘PROCEED TO CHECKOUT’ button.
3) Enter your billing details, accept terms and conditions and press ‘PLACE ORDER’ button.
